I was looking into user profile options.
there are two choices for - I140 Filing Type
- Regular
- Premium
What is the difference b/w two. Can EB3 candidate file for I140 Filing Type in Premium category.

Hi - I am currently on an L1 blanket visa and it looks like my company will sell the unit I work for in the US. The parent company will sell the US division - I am currently in the process of applying for my GC - with the I40, and I485 both pending. I had my biometrics done today.
Want to gain some views on what my options are if the GC route does not pan out. I am on a UK passport, and would like to remain in the states. The GC is an employment based application - which is apparently quick, but I want to have a plan B. Is the next best option the H1B, and if so, will I be able to apply for this (if needs be) inside the US with another company if they are prepared to take me on?

Hi,
Need quick suggestion:
Company A filed for GC. Labor and I-140 was approved. I-485 was filed during July 2007.
I changed employer in June 2009; replied to RFE and filed AC21 in July 2009.
I came to know that my GC sponsring company is going to close the company soon. My current immigration attorney is suggesting that if that happens; and if INS came to know that GC sponsring company is closing down, they will revoke my I-140.
Is it true? I thought after AC21 is invoked; whatever happens to GC sponsring company, it will not impact my GC application in any way.
Please advice.

Hello everyone, thanks in advance for any reply.
I mailed in my wife's I485 and I130 together (she's from China, and we just got married a month ago), and I just realized that I forgot to include the marriage license with the forms!
Now, what are my options? I noticed that they have not cashed my 2 checks yet, should I cancel them so I at least don't get charged for the forms that will be rejected?
Or, is there any way for me to mail the marriage license separately and hope they get it?
Right now, I think it would be better to just redo the forms, but do I have to wait for the forms to get rejected first?

The New York Times carried on its front page this morning a Nina Bernstein article that will no doubt cause a shake up at Immigration and Customs Enforcement over what can only be described as a major scandal in the way the agency has dealt with sick detainees at the agency's detention facilities around the country. I am currently on H-1b and my wife is on H-4. My current job will be terminated on 8/15 and my wife has received H1b approval notice to start full time on 10/1. We have a US born baby who requires future post-surgery follow-ups. I was on F-1 visa, requested OPT through the university, but I didn't applied to USCIS, because I got H-1b premium processing approval. My wife has a valid H-4, and unexpired B1/B2 visa. So my questions are:
a) Between 8/15 and 10/1, are we out of status?
b) I should file a change of status. Should I file
(b-1) H-1b to H-4 directly (effective 10/1)?
(b-2) H-1b to B1/B2 (before 8/15), then B1/B2 to H-4 (effective 10/1)?
(b-3) H-1b to F-1 (before 8/15), then F-1 to H-4 (effective 10/1)?
(b-4) F-1 OPT with university endorsement, if they are willing to do it?
c) Do I need to go abroad and actually get B1/B2 visa since I never got one? I think a change of status should be okay.
Any suggestions are welcome. Thanks.

Yes I got it for my daughter. The CGNY website lists all the documents required. I sent
only the photo-copies of all the documents they mentioned, each page notarized.
I got PIO card in exactly a week and I live in North west Ohio close to MI border.

You cannot file for a new EAD more than 120 days before the old one expires. You are within that 120-day period, so I would apply ASAP.

I received a FP notice to attend on 11/23/07 (the friday after thanksgiving). The lawyer feels that they may be closed on that day and would like me to reconfirm the appointment.
