Option1 -
Get enrolled in some university and get F1. Full time classes can give you 2-3 years of stay.
Option2-
Covert status to B1/B2. That would just buy you 6 months at the max.
Option3-
Pack up and go back to home country. Live a free life.

I have a PD of September 2007 in the EB-2 category. I am currently on an H1B 3 year extension(after 6 years) on basis of an approved I-140.I am a physician and would like to pursue a fellowship given that it is unclear how many years I will have to wait to get a green card. Can I extend the H1B (change employer),given that I got the 3 year extension of the H1b on the basis of an approved I-140? What are the consequences for the H1B visa (employer change).I know I may have to start my green card process all over again.Thank you.

Thanks for looking at my questions. I have an approved eb2 case with priority date 11/2007. I am waiting for eb2 India to become current for applying for EAD for my wife. She applied for medical residency and the programs she got calls for are sponsoring J1 visas only. I have a phd from US university and applying for EB1 OR through a semi conductor company anyway.
I am in dilemma whether to apply for EAD for my wife or let her go on J1. J1 has implications later for medicine students but given the randomness of USCIS, I am never sure when eb2 date would be 11/2007 for eb2 485 or denial of eb1 or application.
Please advise me over this dilemma.

Guys,
I have been reading some posts since yesterday. I still haven't been able to get a confirmed clarification.
If I am on H1, and change my status on H4 for lets say 8 months. Then decide to start working again on H1, would I be counted against the cap again?
I have been reading some posts which says if I have been counted against the cap once in last 6 years, I won't be counted again. Does that apply when one changes visa status from H1 to H4, and then back to H1.

Can someone clarify my issue.
I applied for H1-b in 2008(I was in L1 when i applied).My employer never gave me my recipt number and i didnt even knw the status for a while ( though he said he applied without COS).Later he told it was applied with COS.
Later after numberous calls and mail he gave me a recipt number ,but the
status on USCIS website was "Notice Undelivered as of June 2008".
I could never find ,whether it was RFE or Approved status.I called up USCIS they said employer has to call to confirm the status.My employer said he will follow up with USCIS but he never did and he is absconding now .I cant reach him ,no phone,no mails.So i continued on L1.
Since my extension is coming up.I wanted to make sure my status hasnt changed because of this issue.
Has anyone faced this situation? Had that notice (undelivered) been an approval letter ,would that change my status though it was never accepted (Its undelivered as of Jun 2008)

I am a Canadian in the "Approved I-140, waiting for 485 Limbo" status. I have a prority date of March, 2004. I find IV a good source of both information and encouragement and I would like to know there are others near me who feel the same. Hope to hear from you soon?

My H1B expired when I renewed (last month) my EAD. I e-filed it and selected H1B "SPECIALITY OCCUPATION". I got my new EAD card in hand within 22days from the day I filed.

Guys,
I feel that I am in serious trouble.
I am an employee of a company which was recently raided by uscis. My 6th h1 expires April 2009 and we applied for 7th year h1 extension based on
the approved labor (labor filed in March 2008).
I am not sure at this stage, that my h1 will get approved since the company is under the scanner.(I checked the LCA and It shows the work location where I am working and not from IOWA which is good)
So..what are my options now
1) Can any other employer file for extension based on this company's approved labor?.
2) If I join the other company, what documents do I need to show to USCIS that the labor is approved from my old company(the company under scanner)?
Please let me know..what you guys think...Any help will be greatly appreciated

Hello:
I got two EAD extensions in past and applied for the same third time. Earlier, EAD Renewals took only 2 weeks time ( from VSC). But this time it is not the case. It is still pending for 4 weeks now.
Are there any recent EAD renewals from TSC for anyone? Please let me know if anybody has similar case?
PS: Since my case(I-485) was transferred from VSC to TSC, I applied for EAD renewal at TSC this time.

My I-140 was approved from Nebraska service center, but my attorney sent my I-485 case to Texas. I came across few people here on IV who have experienced the same.
Did USCIS provide any information regarding this? If so could you provide the link?

Hello,
It has been over two years I got my EAD, and I am also on H1 and my H1 is valid up to May, 2011. Now, if I want to switch to a new employer, I want to know if there are any complications...I read that we can always switch to new employer and can still retain the priority dates. Is it true? What is NOID? Is it possible for the old employer to revoke my I-485? or can they do anything that affects my Green Card status or the legal status in the country?

There were two intervening vendors and the end-client declined to provide a letter stating that there is no requirement in law for them to provide any such letter. We had to get together convincing secondary evidence. I was highly doubtful we will get the approval, but we did. So, despite the January 8 memo from USCIS, there is life yet for consulting industry.

I called USCIS and checked about it. The officer said that she shoul dnot have applied online and made the payment. She should have sent paper application only. And that there was no need to pay any fee. He said that the amount once paid to USCIS can not be refunded back. Ridiculous.
