    I have an approved I797 from last year qouta. I got a 221g when I went to stamping for my H1 visa. The 221g was regarding some documents which the employer had to provide. Subsequently I obtained a L2 visa and I am now in the US. I would now like to apply for a change of status to H1.In this regard I had the following question:

    On my L2 I have applied for a EAD about 3 weeks ago. USCIS says that it could take upto 90 days to approve the same.During this time if I apply for a COS to H1, would it influence the decision making on the L2-EAD approval or they are completely separate processes?

    I have a question for the gurus. I have my GC application in process- priority date March 2006, EB2 I. When the application started my wife was on H4.

    Now my wife is on H1B, and her employer has asked if she would like to have her GC processing done. Question is that can she get her application started and can I be the beneficiary on her application. The rationale behind this thought process is that considering the economic conditions, is this a safety net that one can use?

    You cannot use the “AUTO VISA Revalidation” rule once you go for stamping.

    Please share your experience of H1b visa stamping in Halifax or Quebec (Canada).
    I am planning drive to Halifax or Quebec end of this month.
    I am intended to use “AUTO VISA Revalidation” rule.
    I am from India and I don’t have any U.S. degree.
    Any suggestions.

    Also, do you know if we have to do the Fingerprints before we get the EAD or do USCIS sent EAD and then request fingerprints ? Thanks!!

    Dear Core Team,
    What is IV's stand on people still stuck in LC backlog in PEBC/DEBC, There are applications pending there since 2001/2002. If this becomes law that I-140 filed after May 2007 will be rejected then the biggest impact will be on such people as even labor is not cleared and even after waiting for so long they will lose everything.

    I am a US Citizen and will be filing a petition (i 130) to bring my mother over on a greencard.
    Recently on her visit to the US on a visitor visa she was marked as NO AOS/COS/EOS on her I - 94
    and she left by the date specified on her i - 94.
    My question is will it have any effect on her GC petition and what is the current wait time for consular processing on an i-130 petition

    Dear attorney,

    please help me understand my problem.

    Through company A , My I 140 has been approved and have my 485 filed too ( i do not have the receipt number or the approval letter for the 140). I am still using the H1 from Company A
    Can i move to Company B, on H1 transfer file Ac 21, and have perm and Labor approved through company B and then port the date of company A priority date
    Without me having a proof of 140 approval will it be possible to port to the earlier date.
    Or should i have company B file labor and 140 as a future employer have 140 approved then port it and move to employer B.

    Ten weeks into the new Congress, it is clear that revelation, not legislation, is going to be its real product.

    While President Bush threatens to use his veto pen to stop some bills and Senate Republicans block other measures from even reaching his desk, no force in Washington can halt the Democrats' investigative juggernaut from uncovering the secrets inside this administration.

    For the first six years of the Bush administration, these aides were allowed free rein to carry out whatever policy or political assignments they wished -- or supposed that the president wanted done. A Congress under firm Republican control was somnolent when it came to oversight of the executive branch. No Republican committee chairman wanted to turn over rocks in a Republican administration.

    You have to feel a twinge of sympathy now for the Bush appointees who suddenly find unsympathetic Democratic chairmen such as Henry Waxman, John Conyers, Patrick Leahy and Carl Levin investigating their cases. Even if those appointees are scrupulously careful about their actions now, who knows what subpoenaed memos and e-mails in their files will reveal about the past?

    They will pay the price for the temporary breakdown in the system of checks and balances that occurred between 2001 and this year -- when the Republican Congress forgot its responsibility to hold the executive branch accountable.

    It was a fundamental dereliction of duty by Congress, and it probably did more to encourage bad decisions and harmful actions by executive-branch political appointees than the much-touted lobbying influence. In reality, many Republican members of Congress did not mind what was happening because they were able to get favors done in that permissive climate. Now, the Democratic investigators will publicize instances of influence by members of Congress, and the political fallout will not stop with New Mexico's Pete Domenici and Heather Wilson.

    Democrats find it easier to investigate than to legislate. With their major initiatives, from a minimum-wage boost to a shutdown of the Iraq war, stymied by Republican opposition, the Democrats are understandably making "accountability" their new goal -- meaning more and more investigations.

    Fulfilling that promise, later in the week the House passed a series of bills that stripped some of the secrecy from executive branch documents and decisions.

    Accountability is certainly important, but Democrats must know that people were really voting for action on Iraq, health care, immigration, energy and a few other problems. Investigations are useful, but only legislation on big issues changes lives.

    I was recently on H1B and renewal/extension was denied. So I left promptly to go back to Canada to establish residence there and start working. Now I need to return to the USA to retrieve some personal belongings, wrap up my residence and bring a car back etc...

    My question is, when I enter the USA for the first time after being denied H1B will I have a hard time and will they be reluctant for some reason to permit me to enter as a visitor? I can't see why they would but who knows???

    My family is still in the US and I need to help to get them prepared to come back

    Does anyone have any URLs of sites that go into Photoshop 7? I haven't had much of a chance to get into playing with this yet, but I'd like to know how to do all these wonderful graphics you guys keep coming out with. :)
