I just received the I-140 Receipt Notice and noticed that the section I am filed is not correct Sec.203(b)(1)(c) i.e multi-national Executive or Manger
where as I should have been filed for sec.203(b)(3)(A)(i) or (ii) Skilled Worker or Professionsal
I am going through Substitution process and the Previous I-140 was approved for sec.203(b)(3)(A)(i) or (ii) Skilled Worker or Professional
Now my question is what is the procedure to rectify this ? Also will I hold on to the processing dates {NOT Priority date} (say May 25th) for I-140 or should the lawyer file new appliaction which will push my I-140 petition dates to June?

My wife couldn't get Xray on a failed TB skin test, because she was pregnant at the time we filed our 485. Our priority date will be current in August.
Should we wait for a RFE on her medicals? Or is it possible to go ahead and do it, and send an update to USCIS?

Hi
it seems most/all of multimedia jobs are project-based/short term/freelanced, is there any multimedia permanent job which you can sit in a fix studio to work on, maybe 5 days a week, just like some administration/office fulltime position (e.g. clark/marketing person).
Work in some multimedia comp/film company maybe one of the solution, anyone could give me more ideas/suggestions & I dont know which multimedia/film is the big one / famous...:puzzle:

We filed for our 2nd AP on July 2nd. They received it on 8th and mine was approved on 22nd. Got my AP yesterday. No idea what happened to my spouse's. I got that RN from the back of the check and called USCIS. I entered the 10 digit RN and it said not enough numbers entered?? So i called again and said no RN and i got a cust service rep. I gave her the RN and she said they received it on 8th and is still processing it. She said it doesn't matter whether we filed together and asked us to wait 6 months.
Is this normal? I just hope the other AP is not lost.
Also since there is no expiry date on the AP, is it to be taken as its valid only for 1 year from the date of issue? We never had to use our 1st AP.

I am planning to visit India for a10 days in October. I have a valid h1b status till 2010 which I thinking of getting stamped at new delhi. But it seems the PIMS verification delay is making people wait for weeks and months. I have an AP which I can use to enter as an alternative. But I wanted to know if anyone had experience in stamping at the delhi consulate? Do they keep the passport if it is send for PIMS verification? In that case I'll drop the idea of getting it stamped and use my AP (though I want to avoid doing that snce I want to maintain my h1b status).

IV Team,
I'd filed my concurrent EB2 I140+I485 on Aug 17, 2007 at the Texas Service Center. I have been trying to check the status of my I140 petition online for the last 3-4 months. Every time i try to do so, i get the following error message:
"Case Status Retrieval Failed. This Receipt Number cannot be found at this time in this automated system"
Am I the only one with this problem ? or are there others experiencing the same issue ?

Could one of the lawyers/expert please provide their opinion on my situation?
In 2004, my H1B extension was denied and later on approved in Nunc Pro Tunc. The nunc pro tunc process took a total of 64 days and when approved my I-94 was NOT back dated. Hence, I do not have I-94 for 64 days. Later on in July 2007, I filed for my I485.
Since my approval, I have not traveled outside the country and I am currently on EAD based on my pending 485.
The question I have, it's bothering me a lot, Will the gap in I94 for 64 days cause any problems in my I485 approval?
Please advise.

Don't know if it will help anybody since i'm a June filer. I didn't file EAD along with AOS in June, but on July 11th i filed EAD with 485 RN. My check got cashed on the 13th and got the receipt# from the back. The case status says they received the application on 12th. I haven't got the Receipt notice yet though. I did write I-765 on the package.

My girlfriend (from Russia) and I have been for about 3 years and living together for the last year and I've recently decided I want to propose this summer. She is currently here as an I-9 form (she's in grad school), but her student visa is expired. She recently got a job on campus and while she was going through the paperwork yesterday realized that her passport is going to expire next April (2012). So she is now planning to go back to Russia at the end of the year to renew her passport and apply for a new student visa. As I think we'd both like a longer engagement, and with a fiance visa you need to marry within 90 days of entering the country, we probably wouldn't want to apply for one at that time. However, I'm now wondering if being engaged will cause any complications for her when applying for her student visa. Any information or advise you could give would be greatly appreciated. Thanks!

I have I-140 approved from my old employer. My new employer is starting my PERM. We plan to port my old priority date. My question is at what stage of GC process from new emplyer can the old priority date be proted - PERM, I-140 or I485?

Do you need to submit copies of your approved LC or I-140 to support your stay beyond 6 years? I don't see it mentioned in the I-129 application.
And do you say yes or no to the following question (Q.5, Part C of H-1B Data Collection and Filing Fee Exemption Supplement form)?
"Has the beneficiary of this petition been previously granted status as an H1-B nonimmigrant in the past 6 years and not left the United States for more than one year after attaining such status?"
This probably wishes to know whether you have a reason to stay here for more than 6 years. But I don't see anywhere to explain that. Any help is greatly appreciated.
