How come a govt. organization that is never known to do things on time, all of sudden is able to approve 60000 GCs in such a short period ? Why did they have to do it by end of June ? If they had done that by end of July would anything have been different for the folks who were getting the Green Cards - NO.
I think this was all planned. There was a reason why the numbers were made current and there is a reason why the numbers became unavailable.
I think we should get to the bottom of this. This stinks ......

It means nothing. The second 485 was denied since you already have a green card so
Adjustment of Status is not required.
BTW - why did you file two 485's ?

I had a really good experience in Nogales last week, I got my visa stamping on the same day of my appointment and the NVS International team was great. They arranged everything for me:transportation from the Tucson Airport to Nogales, they arranged my hotel stay, bank draft as well as transportation from the hotel to the consulate. I received RFE that says" your application contained form I-693 in which the required TB skin test was not conducted. Please note there may be conflicting information on some published form I-693 instructions regarding when the chest X ray Report should be performed. It is required only when the TB skin test indicates a reaction equal to greater than 5 mm, or when the reason for why the TB skin test is medically inappropriate to perform has been annotated on theform I-693. Please submit a newly completed form I-693 indicating the results of the required skin test."

After consulting with the doctor they filled up new I-693 from with 2007 test results and gave me in a sealed envelop. I need to know whether 2007 results will be acceptible to USCIS or do I need to do it gain before I submit response. Please advise.

Hi,
I have paid $60 for a citation (sale of tobacco products to minors) in 2004 in texas. do i need to mention this in my 485 application? does this effect my green card process?

Hi
Now that the EB2 dates have moved forward till Dec 2003, how many of us expect our approvals in the coming months ? Would the bulletin move forward in coming months or would go back or may be become unavailable again ? Any thoughts ?
I hope the same forward movement happens for all EB3 applicants too.
How does one now expedite thier case if they are current ? Just by 1-800 .... calling or Infopass ?

I-140 processing date isn't country specific, but make sure check the date for the center you have applied to - the date varies by center

i am guessing, your stamped visa (and also I-94 card on your passport) expires feb-2010. Since you have H1B (I797 notice), it should have I-94 attached to it with Feb-2011 date. If not then you need to go out of US , get visa stamped and enter back.

My I-485 is pending with EB3 Feb 2006 priority date. Invoked AC21 and currently working for a different employer. Have Masters degree and 9+ years of experience.
Is there a way to re-apply for Green Card under EB2 category thru a 3rd employer and retain the old EB3 priority date?

I sent my application to vermont based on the USCIS answering system on June 30th that folks with approved I-140s should send 485 applications to the center where it was approved. Any ideas, if there is a problem with that and if the app gets transferred how much time it will take.

Your post raises so many questions it is hard to know where to start.
The obvious one is if you do not have an employer, how have you got an H1B visa since it is the employer who petitions for it?
Second thought, where are you right now? Still in your own country or the USA?
In response to your question about a green card. If you are going to follow the employment based route, by definition, you are going to need an employer to get this process rolling. Starting with PERM labor certification.

1) Labor filed in EB3 in June 2004. The labor was filed in non-PERM and approved. I-140 was filed in Aug 2007 and it is approved in Dec 2008 with Priority date of June 2004
2) Labor filed in EB3 with same company in May 2006 through PERM. Got approved in 2 months and I-140 applied and approved within 12 months in April 2007. Priority date is May 2006. Applied for 485 in Aug 2007 and have EAD/AP based on it.
I am no longer with the company (quit after 180 days after 485 was applied) and am working for another company on H1B using AC21.
Question is, can I port priority date for 485 processing from May 2006 to June 2004 in my case where I have changed employer. Note that by time June 2004 I-140 is approved, I am no longer with that company.

2 years after mine was approved... Even though we had filed at the same time... Nevertheless we are happy... Good luck to everyone!
