If H1B extension gets denied and my employer will appeal it. My questions are
1. Can I allowed to work until I decision is made on appeal?
2. If appeal is denied, from when I will be consider as out of status? (from I-94 expiry date or appeal decision date)
3. After appeal denial what is the grace period to leave the US?
4. Can same employer is allow to file another H1 petition for me?

I am getting ready to file for my 485. I have a problem, and I am not sure how to go about it --
My wife's birth certificate has her name listed differently than it is. The birth certificate has a temporary/pet name. Is there anything I can do now, in next 14 days, before I can file for 485? Will any kind of affidavit help?
Appreciate all your suggestions.

My Wife had her COS from H4-H1, and I filed my I-485 in July with my wife as secondary applicant and already got our EAD,AP. We are planning to Visit India this month and my wife wants to use her AP while travelling back to US.
1. Is it advisable or are there any issues with using AP.
2. Can she use AP that she received as a secondary applicant and continue to work on H1B with her current employer
3. In Case her Status changes to EAD, can we reinstate her H1B at any point in time without counted against H1B Cap.
Pl Advise.

If you have a phd, is it automatically EB1? or do the rules of employment should call for phd apply?

I am a I-485 EB waiter and applied before August 18th. So I have to pay a fee fo 305 dollars. However when I went to check the I-131 instructions for e-filing, i could not find any information if we are eligible to e-file?
has anybody e-filed Advance parole.

Conclustion: "This Court finds that the FBI owes no duty to an applicant to process his or her background check. I have married my wife last friday. we have been living together for almost two years and own a home together for 6 months. I have been in the stats on A2 visa up until now (3.5 years). I have the doctor's letter on hand and I want to apply for my adjustment of status by early next week. I was told that I will ( MUST LIKELY) receive my I-131 travel document approved in no earlier than 3 months from the time of filling. I have bought tickets to go with my wife to New-Zealand for our best friends wedding on november 5th which means I won't have the travel document on hand in time.
What can I do?

I have seen references that if there are different I-140 apps approved per family, there is a possibility of going for the 485 stage separately. Also I have seen posts stating that one can go for AOS and the other for CP.
How do you communicate to USCIS that for one you are doing AOS and the other you are doing CP, with reference to the 485 stage? When does this really happen?

This question is for my wife. She is currently in her 5th year of H1 which expires in Oct-2011. i.e Her 5th year ends on Oct-2010. She is planning to quit her job now (Aug-2010) due to personal reasons and plans to switch to H4. Her employer (Company-A) has already filed for her GC and her LCA and I-140 is approved, but I believe they will be discontinued once she quits. So here are my questions -
1. Since she will have a little bit over 1 year remaining on her H1, can she file for H1 again if she get a new job offer?
2. Assuming that her next company (Company B), files for a GC within one year, Will there be a problem getting her H1B extended ? Since her new LCA (with Company-B) will be filed less than 365 days before her H1b expires.
3. OR Will USCIS look for the LCA filed by Company-A and grant her H1B extension?

Hi,
I wish to scroll horizontally using two custom buttons (a left & a right one) in a FlowLayoutPanel, while disabling the autoscroll properties, as I do not wish to have the scrollbar. The controls that will be added into the FlowLayoutPanel will be subjected to changes, as it depends the number of data in the database.
So is there any tutorial/website that anyone can recommend for this related problem?
And also, I do know what to put for my horizontalscroll.maximum and minimum value as my flow direction is RighttoLeft.

I recently got my I797 approved (on Oct 19) but, the USCIS denied my extension of stay, and I need to go for stamping in Chennai (as per I797). My question:
1. Can I attend the interview in Canada/Hyderabad consulate instead of Chennai. Company attorney said that should be ok and filing I824 for change of consulate would take long.
In case you wanted to know more details about my case:
-Possess I797 from Employer A until Nov13, 2009.
-Filed for H1b extension with Employer B in Feb, denied in Jun15. payroll with Emp B Feb onwards.
-Re-filed for extn with Emp B in Aug4 finally approved on Oct19 but denied extn of stay.
