H1B Visa Lawyer Blog Has Just Posted the Following:
The Administrative Appeals Office (AAO) Processing Times were released with processing dates as of August 1, 2010.
If you filed an appeal, please review the links below to determine the applicable processing time associated with your particular case.

The current processing time for an I-129 H-1B Appeal is 13 months. The current processing time for an I-140 EB2 Appeal for an Advanced Degree Professional is 24 months; for an I-140EB3 Appeal for a Skilled or Professional Worker is 25 months.
Most other cases are within USCIS's processing time goal of 6 months or less.

Our AP expires on August 30 and we don't have any plans to travel this year. We have only plans for next summer.
Do I still need to get my AP renewed now? or Can I start my renewal process in next spring?

Please let me know how do I convert TR labor pending in BEC to RIR.
Accoding to recent law, I know that we can do it
My original application was filed under RIR and my RIR has been rejected and my LC went back to TR queue. I also know that you can again convert back to RIR from TR even if original RIR is rejected.Blood $uckers took 4 years to tell this.

All,
I recently received my FP appointment date, but I have to be on a conference the previous day. If everything goes well, I can arrive to my appointment without any problem.
But if my flight is delayed or cancelled I might risk being late to the appointment. My appointment is 10:00 am in the morning, are they very strict about the timing for FP appointment, or can we go a little late if we were delayed? Can you please share your experience?
Also, How early should we call in to postpone the appointment?

Hi,
My family had visited me way back in 2004 on a visitor visa. Due to unavoidable circumstances, they had to stay beyond the stipulated 6 months ( for 2 more months). We had requested the govt. for extension approval and it had been granted then.
We would like to have them visit us again by Nov of this year. However, when they went for the visa to consulate(last week), it got rejected, because the consulate person informed them that they had overstayed last time around.
I would like to know when can I legally apply for the visa again? And is there a way I could enhance my chances of an approval, rather than a rejection, next time I try. I am working on an EAD and my husband had filed for I485 for our family(I140 approved stage).
Any advise would be appreciated.

Now, if I want to switch to a new employer, I want to know if there are any complications...I read that we can always switch to new employer and can still retain the priority dates. Is it true? What is NOID? Is it possible for the old employer to revoke my I-485? or can they do anything that affects my Green Card status or the legal status in the country?

Yes, I have received receipts for 485, EAD and AP for me and my family on 10/3.My case was filed on Aug 14th, received by NSC on aug 15th, Receipt Notice Sept 26th.

I guess USCIS is sending Receipt Notes according to priority dates meaning with 2006-7 priority dates will get receipts later.

Hello Attorney,
I have 6 months left on my H1B-I797 to expire. My visa on the passport got expired in 2007. I am planning to go to Tijuana, Mexico for stamping. I work for a financial company for past 4 years. I have approved I140.
Can you please advise if i can get the visa stamped? I have to visit India in May and hence cannot wait until the my H1B extension is filed and approved (based on my approved I140).
I am confused and worried that the consular officer may say that you have less than 6 months of validity on I797 and may deny the visa.
Can any one please advise?

I got my EAD approved from NSC on 25th. I see a message-- card ordered. Today there is one LUD , approval notice sent.
