    I was laid off in early April, and the employer told me that they would revoke my H1B 30 days later (early May).

    Now finally I get a job offer. The new employer can start to work on my h1b now, but the starting date will be late July.

    I have an EAD right now based on my approved 140 and pending 485 (>=180days)

    I talked with my attorney, and he said I would definitely have to go back to re-activate my H1B abroad, so I should use EAD instead of doing H1B.

    Is it true that I have to go abroad to re-activate my h1B? I saw some people transferred sucessfully

    Any thoughts? Thank you very much.

    While there are some politicians genuinely concerned about the subject of immigration who are backing anti-immigration laws because they believe in the cause, there are many more who have jumped on the anti-immigration bandwagon to score political points (John McCain - I'm talking to you). I wonder if politicians in small towns that don't have a lot of fat in their budgets are going to re-evaluate the costs and benefits when they have to explain to constituents why they have to pay hefty fees to plaintiffs in lawsuits like this one in a small town in Nebraska.     a) H1 extension(I797) approved but no I94
    b) Visa stamp and I-94 expired when I applied ( my mistake)for extension but I-797 was valid. Have EAD and Advance Paroll
    c) Wife is on H4 and I cannot add her to greencard process because priority date is not current.
    d) I need to maintain H1 for my wife.
    e) She returned to India before her H4 expired.
    f) I work at a client location via a middle vendor so recently found out it does not conform to H1 employer-employee relationship.
    1) Is there any time restriction on when I should get Visa stamping done?
    2) Client agreed to give client letter but I am worried that I will be rejected at H1 visa stamping because of employer employee relationship requirement.
    3) Is it a better startegy to not go to India, send my wife for H4 stamping and bring her to US or is it safer for me to go for H1 visa stamping?
    4) Should I change jobs to a client who will transfer H1 and continue my greencard (possibly apply for EB2) before going to India for H1 stamping?
    5) Please suggest best course of action.

    Hello,

    Please let me know if anybody is travelling from BLR(Bangalore) to BOS (Boston) by British Airways on Mar 1 2011.

    Because my mother-in-law is visiting US and she is travelling alone. If some travel companion is there it will be helpful as she does't speak english.

    I sent the applications(I-140,I-485,I-131,I-765)to Nebraska center 3 weeks ago and it was received by them on December 17,2007(because I tracked the FedEx package).Until today,no receipts yet and my checks are not cashed yet and the receipting update says Current for Nebraska, is the normal or there is something wrong?

    Hi, me and my wife we both r on H1b. My wife works with a solution & service LLC.say company A, now the owner is ready to start a new company, say B,with my wife as partner. She will be just passive investor in the company and getting profits, if any from company B. Can she still work full time with company A?. How can we invest in company B and take profits. is there any problem is getting profits more then 500K in a year.

    What r IRS forms?. Finally any good attorney suggestions for Houston, TX.

    What are the options for business formation,

    Does anyone see any issue with this kind of formation and GC process for me..

    I dont know if people would be interested in discussing the implications of all EB categories turning current. Some of the points to discuss would be:

    1) Processing times for I-485
    2) Effects on future GC applications.

    etc

    3) Whats if the CIR is passed in its current form ? How does that affect these categories is at all

    Yes it is pretty much recognised for h1b purpose or for any other purpose whatsoever. I got my first h1b approval on the basis of my MBA from IGNOU.

    Hi All,
    I have H1B stamped from company A which is valid untill Oct 2008. I am planning to go to India in Jan on my new transferred H1B from company B.

    Do I have to take an appointment in India for getting my new H1 stamped? Or can i just show my new approved H1B from company B on my port of entry in US, when I come back?

    WASHINGTON - California voters continue to disapprove of Congress even more than they do of President Bush, and for the first time Speaker Nancy Pelosi's ratings are more negative than positive, according to a Field Poll released today.

    The poll found that 22 percent of state voters approve of Congress' job performance, with 64 percent disapproving. The discontent was bipartisan, with 70 percent of Republicans, 63 percent of independents and 58 percent of Democrats giving Congress negative marks.

    Those findings, taken in a survey of 1,201 voters from Oct. 11 through Oct. 21, track national surveys. A Los Angeles Times/Bloomberg poll during the same period also found a 22 percent approval rating for Congress. A CBS Poll registered a 27 percent approval rating.

    Bush earned a 27 percent approval rating from voters in the same Field Poll.

    Political analysts give several reasons for the low marks: Democratic voters' dissatisfaction over the inability to change Iraq war policy, Republicans' opposition to Pelosi and other Democratic leaders, and a sense by many voters that Congress can't come to grips with tough issues such as immigration.

    "Republican reaction has remained about the same this year, but the real trend is that rank-and-file Democrats and non-partisans are displeased because they expected more from the Democratic Congress," said Mark DiCamillo, director of the Field Poll.

    Pelosi, a San Francisco Democrat, earned a 48 percent approval rating in March, two months after Democrats took over Congress. That dropped to 39 percent in August and 35 percent in October, with 40 percent disapproving and 25 percent registering no opinion.

    "Iraq is the anchor weighing down Bush," DiCamillo said, "and now it's an anchor on Pelosi because of the complete inability of Congress to change course on the war."

    Pelosi and other Democratic leaders held meetings in the last week to find ways to improve their "message" about what they call the New Direction Congress, highlighting such legislation as the minimum wage increase and ethics reform.

    Despite the low marks for Congress, Republicans had little to cheer about in the new Field Poll. Voters gave an approval rating of 34 percent to Democrats in Congress, and 20 percent to Republicans.

    Only 29 percent of Republican voters in California approved of the GOP performance in Congress, with 53 percent registering disapproval.

    "That 2-to-1 disapproval by their own party really jumps out," DiCamillo said. "Republicans in Congress are now playing 'prevent defense' for Bush on the war and on domestic issues, and Republicans in this state do not approve of that."

    The state's two senators, Democrats Dianne Feinstein and Barbara Boxer, earned higher marks than Pelosi and Congress overall, but the approval ratings for each senator dropped 10 percentage points since March.

    The survey showed that 51 percent of all voters approved of Feinstein's job, with 31 percent disapproving. Boxer's approval rating was 44 percent positive and 35 percent negative.
