Hi all.
I just came back from Canada after 4 days using 30 day rule as I wanted to recoup few days so that my co. can apply for 7th year extension because my LC shall be pending for more than 365 days. My question is does my employer have to file two seperate LCAs for each I-129 application or same LCA copy can be attached with each I-129 ( 1st I-129 for extension for 3 days, 2nd I-129 for 1 year extension ) ?
( NOTE- MY I-94 WAS EXPIRING ON 15TH MAY AND LABOR CERT. SHALL BE PENDING FOR MORE THAN 365 DAYS ON 17TH MAY, SO I HAD TO TRAVEL OUTSIDE USA TO RECOUP FEW DAYS)

My wife was deported after being in the US for more than 9 years. She spent 4 months in jail. Your first question will be why didn't I get her papers for her, she didn't want to go through the hassles. We have been married for 4 years. She was arrested when we attempted to return from Mexico after a vacation she was on. They confiscated the vehicle and I was released without a record, gave me a break because I am retired military.
I have heard that there is a pardon process. Since the rest of her family is still in the US, we want to be able to return. I am in the process of moving to Mexico to be with my wife.
Can anyone shed some light on a "Pardon"?

Dear fellow 'immigrants stuck in process' from MD,
I suggest that we all get together to discuss how we can help the effort that immigration voice has undertaken. I did attend an IV meeting in NoVa a few weeks ago, I am keen on pushing an initiative of meeting periodically to discuss how we can collectively help our cause on this side of the river.
Send me an PM to express your interest and I will send out an email with further information.
If the MD state chapter is already having meetings, please ignore this message; but some one please send me the information on when these meetings take place.
Also let me know what you all think of this proposal?

Dear Attorney,
I work for a non-profit State University (6+ years), and my supervisor is letting me work from Canada for a year or so. As my university HR needs to have an H1B permit to keep me on the payroll, my University's International Officer is willing to keep my permit valid and keep renewing it even beyond 6 years as my I-140 is approved. She says that I can also apply for an H1B visa in Canada and visit US whenever my supervisor asks me to do so.
Wondering if this is doable without violating the USCIS & LCA rules and regulations? Thanks.

Hello All,
As per the latest regulations, the employer has to pay for all the labor application cost. My employer has agreed to do my green card, but are little hesitant to pay the cost (due to budget constraint). What legal options/adjustments can I make with my employer so that the cost process is not delayed? Thanks in advance.

You are already counted in the quota. So it is just transfer. But for transfer need recent paystubs. Consult a lawyer how to handle this. Definitly you no need to wait for April 1 st quota for new H1B.

I know this is really stupid but I can't seem to find the answer to this one:
- I am doing a paper filing of 1040. Do I need to send 1040 as a two sided print out or single sided printouts?
The CA 540 specifically says single sided printouts but am not able to find this information for 1040.

I have taken a 2 day stop over in Dubai while coming back to USA in April 2010. I booked my flight on Emirates. Emirates will sponsor my visa. But i am not sure now they allow Advance Parole as when i apply for visa one of the requirements says "Travel documents, such as re-entry permits and refugee documents are not permitted"

It seems USCIS has set a quota of �X� number of 485 applications till SEP �07.Once that quota reaches, dates will retrogress.
After that 485�s will be processed by PD and not by RD.

All,
Over the past few days we have been successful in getting good media attention BUT except for NYT, the coverage has not focused on the issues that are relevant and will draw the attention of the policymakers. I think the media drive should focus on getting the following issues highlighted:
1. Lapse in protocol when issuing green cards
a) Green cards issued WITHOUT security clearence
b) Green cards issued to those whose PD was NOT current in June
2. Obvious intent to NOT accept applications in July so that they can receive the same with a higher fee in the future. This at the cost of making a mockery of hundreds of thousand of hopeful legal immigrants
