Hi,
My PD is 2005 and my I-485 was denied on the ground of my birth certificate and I got more proof from where I was born and submitted to USCIS and it was accepted in August 2009 and since then it has been more than a year and there is no update in the online status update for my I-485 application.
Lot of my friends from Late 2005 and early 2006 got the GC's last couple of months. I have requested my Lawyer to make a AILA inquiry? What else can I do at this point?

One can contiue to stay using I-485 receipt without valid I-94. afasik I-797 can be used only if you filed H1 extention after you came back on parolee.
If a person travels on AP, he will get a new PAROLE I-94 which shows expiry date of 1 year from the day he entered on AP. Can the person stay in US AFTER that expiry date and continue working using a valid I-797?

Domicile Certificate i.e. Certificate of nationality shows the date of birth.Can this be used instead of Birth Certificate?

Hi,
My current status is
I currently work for Company A (on H1B) and Company B is processing my GC (EB2, I140 approved; I485 in process) .
This month, I found a new job with Company C which I have to join on EAD (they don't do H1Bs). Also, in this month's bulletin, my PD became current. I had a few concerns/questions
1) Could the change in employment trigger any flags since I am changing companies and this is a future employment GC case (though its almost 3 years since the I-485 was filed)
2) What do you suggest I do since its so close? I waited all this time just not to complicate things (and remain on H1) but then as soon as have to start work on EAD, the date also becomes current (which I am definitely very happy about ) but now since both these events are so close, I am not sure what to do.
3) What other things are there to keep in mind in case of a future employment case?

You can enter all the data, save it and book your date as and when it becomes available. I did it recently for Chennai. But, if you do not book the date within one week of saving your forms, you have to enter the data once again. For Chennai, they normally open the dates 3-4 weeks in advance.

I need to know when can I fly back to US on my H4 visa(valid till 2011 ).
My husband has joined a new job and his H1 B transfer has been filed .
Do I have to wait for new I 797 or Can I just travel on my old H4 visa and
visa transfer receipt notice .( he is filing the H1 transfer by premium processing ) .
His new employer is suggesting me to reenter on old h4 and before my husband
joins their company .
But for me that will be very soon ( not fulfilling the purpose of my visit ).
Any help is much appreciated.:confused:

Illegal non-immigrants did the rally to local USCIS offices. It would be good if we pick one day in 2nd week of July and have a rally to local USCIS offices. This will immediately catch the media attention.

USCIS has not extended its temporary accommodation for delays in the labor condition application (LCA) process. Earlier, USCIS agreed to accept H-1B petitions without a certified LCA, in certain situations, for a limited time. This exception was available from November 5, 2009 to March 9, 2010. The USCIS has declined to extend this exception. Accordingly, all H-1B petitions must be filed with the certified LCA otherwise USCIS will deny the H-1B petition or extension.
Hence, it again is necessary to have an Approved LCA in place for the proper location at the time of the H-1B filing. The reason the exception was not extended is that the DOL assured USCIS that LCAs are being processed within the required seven-day processing time. The DOL, in fact, stated that LCAs are being processed within four to five days which is in fact true as well. It is our suggestion to plan accordingly.

Check with your school's office for International students...Nowadays many schools require that you work their own office....They have an attorney and you just submit papers and they take care of it....

Its mentioned in the application right? You need to provide certified copies of marraige and birth certificates matching your application

just got my GC. Now if I contract for a security clearance job, like Armed forces, or Defense related one through the same employer that sponsored by GC, CAN I BE ELIGIBLE for a waiver of the 5 years waiting period -to what extent is is waived ....100% or only part of the 5 years wait, if at all .
My Company is a US Defense Vendor .
Can someone pt me to the right place where all this is clarified.
Also would the same kind of waiver apply if you work for a Govt agency or it is strictly defense...
are there some other ways where GC-> Citz can be expedited
