Hi,

I need advice from Gurus who have experience or gone through this. I am on H1B with pending I485 and i got married recently. My spouse is on H4.
I have been looking for a job and my employers want to hire me on EAD. If i use EAD, then my wife will be out of status.

Other option is for my wife to get into F1 status.
1. How easy to change the status from H1 to F1?
2. Should i wait to use my EAD till my wife's F1 status gets approved?
3. If the change of status gets denied, will there any problem to her H4 status?
4. Will there be any problem if i add my wife (Assuming she is on F1) to pending I485?

Hi,

I have been doing a lot of research about this online and have even heard from friends that if you transfer your H1 to H4 and apply again for H1, your new H1 application is not counted against the H1B cap. How true is it? Has some one done this before ? Is there any risk involved? Any help would be really appreciated.

For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications. I recommend the Nikon 18-70 AF-S DX zoom in that price range. Right now I use the older 24-85mm f/3.5-4.5 zoom on my DSLR, and find that I frequently use the 24mm extreme and wish it went wider. If you do lots of interiors and don't need a very wide angle of view, then one of your suggested lenses would be better due to the larger aperture (keep in mind that 28mm on a DSLR equals the angle of view of a 42mm lens on film).
