    needhelp...maybe instead of country of chargeability we should ask for grouping by country of birth; this is an actual field required in the I-485 form.

    You are right about priority date. It is not a field available in the 485 form. in the 485 form we reference the approved I-140, which is the only place where your see the "Priority Date" field.

    True, but Airline CAN give some 'guarantee' to get the transit visa for passengers. I flew Singapore Airline, and they arrange transit passenger to take a tour of the city, if the stopover is , i guess, more then 3 or 4 hrs.
    So, I don't buy the argument that its not in their hand. If they wanted they could have done it. Period.


    When one group right in front of your own eyes gets to stay in a hotel and the other group are left high and dry to loiter in the airport (citing they dont have transit visa), I call it absolutely a kind of Discrimination. I dont give a crap about Transit Visa.

    You are missing the key point here.

    Equal Employment Opportunity applies only to applicants who are eligible to apply for that job. It does NOT apply to immigrant visa allocation and any other visa benefit such as H-1B approval.

    In other words, Equal Employment Opportunity is applicable to US Citizens and residents with work authorization (Green Card holders, EAD holders, person with H-1B approved) and this is limited to job hiring, job promotion, discharge, pay, fringe benefits, job training, classification, referral, and other aspects of employment. This does not extend to immigration benefit or opportunity lost due to lack of immigration benefit (such as I-485 approval).

    The attorney i had was Jeffries expensive but good.


    I have a BS in biology and computers (was on F1 visa)
    Then I did research on cancer cells at the university while trying to get into Graduate school. Got my MS in information Science and also an MBA.

    For MBA I did my research on Economic growth and Military spending.
    After MS i got job h1b for a research facility was doing mba at the same time. Switched employer to work for a multi national corporation. Quite my job for multi national because they would not apply green card started work for a consulting body shop they apply for my green card.

    Now Soon I will give my resignation.

    Understandable that Economic Stimumus Package is not a federal recuring benefit. However, ITIN holders (H4s) are eligible to claim child tax credit, why not this stiumuls benefit?. They should be given this benefit if they meet residency requirement. One should contact IRS to include ITIN holders to clain this benefit.

    The IRS cannot make exceptions, since it is written in the law. However, the Social Security Act does not say that the benefit has to be recurring. I did get a reply today from the SSA. They claim the stimulus payment is a tax rebate, not a benefit. However, it cannot be a tax rebate, since the law was written to allow people with no income to apply for the check. There are even instructions on the IRS website that explain how people with no income can apply for the check. I am in the process of getting the opinion of an attorney. I will update you soon.

    One last thing. I recommend that any discussions you have with the SSA be in writing. The SSA manager wanted to discuss this with me over the phone, but I insisted on written correspondence, because that is the only proof you have if this ever goes to litigation. The documents I have gotten so far already contain errors and contradictions that could be helpful in a legal case.

    This is yet another example of how the US is happy to tax us and let us finance Social Security, then place us in a similar category to "illegal aliens" when it suits them.     I disagree that this is a plan at the government level to make EB immigration on par with family based immigration.
    Diversity is a cornerstone of the US immigration policy. It is present in both the main types of US immigration. You can argue about its merits and demerits, however when major immigration reform was debated and legislated in the 60s, diversity was set as a basis. The Diversity visa lottery speaks to this.
    The H1b visa(with its absent country quotas), has now come into collision with an EB system which has these quotas. That is why we are seeing this mess.

    They have said that country of chargeability is not assigned until case is ready for approval. However, whether or not a case is ready for approval is determined by country of chargeability.

    I think pre-adjudication solves this catch-22 situation, and they have been pre-adjudicating quite a bit over the past two years. So, I dont think that this is an issue.

    I got hired by a consulting company A. I had to pay my H1B Fees (at that time i didn't know it was illegal for a company to do that)they were delaying my joining as they were indefinite for finding a job for me. I came to charolette in november start and was asked by the employer not to join them as they didnt have any projects for me. It has been 3 months and iam sitting idle and running out of resources to sustain myself. No paystubs are generated and i might be given an offer by a regular company B for permanent here . H1B txfr requires last paystubs
    which i donot have, but when company B want to hire me what can i do. Talking about my employment to employer A he threatens to revoke my H1B, is there a way out.

    Also in case he wants to revoke my status on H1B could i also complaing to DOL for non payment of pays and that he made me pay H1B fees.

    Please Advice.

    They are worse.. they do not respond quickly, never let you talk to attorneys directly.. have to go through the secretaries and to top all this they mess up the applications.. in short they suck!

    You mean you are in EB3 right now and want to upgrade to EB2, right? Not the other way round?

    If you are in EB2 already, don't move a muscle ! Unless ofcourse you can upgrade to EB1 !

    Is it possible to upgrade from EB3 to EB2, if person is working on EAD after AC21 is invoked and H1 is expired?
