    the good point is that lot of people till end 2003 got their GC's in states like georgia. I guess many people in states like california must have gone to EB2 or gone back to their countries. lot of companies closed their shops but at the same time there was lot of labor substitution. I guess at this point EB3 - (I) cannot do much except pray and sleep(and hope one of the advisors to the president / congressmen tell them that more or speedy legal immigration actually helps US (in housing / SSN mess / medicare / tech innovation / outsourcing etc etc).
    I was talking to a manager (naturalized citizen) of a top company and he said the same ..baby boomers are /will be retiring and you will see more old people in usa rather than youngsters - this is the most important advantage that countries like china and India have (young population).

    as EB2(I) and world wide dates starts to move ahead - I guess future support to IV (or any campaigns) would continue to diminish

    These are really sad set of circumstances. My heart goes out to you. If it is of any consolation, once your 140 is aprooved, you would be able to file for 485 (hopefully in Oct-07) and with a PD of 2002, you should get your GC before most of us..good luck..


    I applied for my labor during sept 2002.Just before my labor getting cleared, they started this BEC 's and sent my application to PBEC and it it was cleared during 2006 April.( after 3 and 1/2 years)

    During this period I got one year of extension for my H1B and sent papers to the attorney for I-140.That stupid attorney did not file my I-140 for the next 4 months just like that.( god only knows what happened bw, my employer and attorney). and at last we changed the attorney and applied for I-140 during 2006 November. and during 2007 Feb I put my I-140 for premium processing.

    Before I get RFE for the premium processing , the USCIS mistook my employer name with other employer and denied my I-140.And again After the attorney clarified them about the RFE , they Put my I-140 into Abeyance state. That means I can not File for I-485 because my I-140 is not in pending state and I can not apply for I-140 again becuase I-140 is not in denied state.

    And for the past 3 months My I-140 is in neither pending , nor Denied state and my attorney does not even answer for the question whether I can Apply for the H1B extension.

    all these years I am very patient , but once the dates are current , I am lieing , If I say that I am not jealous of those who is able to apply for I-485 , who came to USA in Jan 2007.

    Bestin, I looked at your signature, and felt very proud for you. You applied your labor in July 2007 only, and you are fired up to support and contribute to the cause. It shows how aware and alert you are. It shows how you refuse to face this unfair system. It shows that you want to fight for your rights....

    I wished i were here before (IV) but ofcourse its human life isnt.We learn from experience.If at all IV was here before or if there were active forums like this earlier i am not sure if i would have ever thought of coming to US.Now after coming here and learning lessons its almost like we are stuck- not only on immigration but also to maintain our commitments.There were phases wherein i was literally upset on my decision to come to US which i beleive most of us would have gone thru at one stage.

    America always vouches freedom for all,but they missed the point that there is literally no freedom for those who come to US by ethical means.See the plight of USCIS.Its like a monopoly.U can hardly question.A simple example is my wifes L2 EAD.Once she got the FP notice and receipt i sent all relevant documents by USPS delivery confirmation .At the 90th day they issue an RFE asking for the same documents.If it were in India it would have been used for packing samosas.But who knows what happens in USCIS.Now we need to wait again.Can we question them on what happened to the documents i sent?Its unnecessary waste of time.I beleive its high time USCIS thinks on outsourcing to be more effective..
    I am not saying Indian Govt offices are better.

    Just consider howmuch we spent on GC filing?I personally had to spend for filing and attorney and medical approx 7000$ (ya i had to use my company attorney as my labour was approved in last time).If atleast 200000 people did spend atleast 5000 ,then see how much we spent .Atleast 1000,000,000 dollars inside America during June to August 07 out of which atleast 50% to USCIS for something which MAY OR MAYNOT happen after years.And again a confirmed money 1500-2500 dollars every year for attorney+uscis fee for EAD and AP.The figure which i mentioned is just for an example,the actual figure might be twice.

    In addition we spend on travel .A typical Indian Trip for a family of 4 would cost atleast $5000 on Air.If these taxes are considered see how much we contribute.And yes we pay for SSN,medicare for americans to enjoy at florida after 60.

    Inspite of all these,some people here think we are just to steal their jobs and send money to India.If people dont realise they are competent,then their way is to oppose immigration reforms.

    I have seen lots of Americans here complaining on stress and taking stress releivers and yoga.I am sure their life expectancy would be reduced to 1/2 of what they have if they were to undergo immigration inside America now especially from retrogessed countries.Serious its not a joke.:D

    I finally received my I485 denial notice. I had to make 4 infopass appointments to get the letter. My attorney hasn't yet got it. I will be filing for MTR and sending the request to Ombudsman per another thread on this forum.


    Was curious if others have the following in their denial notice:

    last paragraph:"There is no appeal for this decision" This decision is without any prejudice to any future I485 application that you may file....blah blah.."

    They have quotedsection 245 immigration and nationality act [8 USC 12s5]..states " underlying visa petition upon which seek permanant residence has been revoked...blah blah"

    Is this pretty standard?

    I really dont know what the purpose of this thread is, or whether it accomplishes anything.

    It seems to be doing more harm than good.

    if the movers of this thread have no objection i would like to close it.
    i hope though in the meanwhile we can turn the discussion to more productive directions. there is much to be done yet.

    company legal dept. I seriously doubt any individual will ever consider use them. And many of their lawyers and paralegal are certainly heartless towards the beneficiaries, they suck corporate's money and only respond to employer.

    i would like to move away from the focal issue of rally participation for a moment- only to broaden the question. yes i perfectly realize that there are many motivated members that had genuine compulsions of various kinds that did not allow them to consider being in DC. i could be one of them tomorrow. i also know that they are not the majority of non attendees. still, to again answer a previous question, 2,000 registrations was a pretty good number from a crowd that likes things handed out to them. my question though is related to other iv activities. going to a rally is a bigger decision, true. so how many of those who are espousing moralistic platitudes about "cheapening" and "not associating real people with userid's" or blaming chandu's words have participated in other actions? have you joined a state chapter? are you active in it? did you attend a meeting if you belong to an active chapter? if you have no chapter did you volunteer to start one? did you volunteer for pre rally activities? have you met your local lawmaker?

    i could go on, but those are key questions. those who complain about trivia need to step up and show their own commitment. the way of this country is to petition government by lobbying your lawmakers. nothing cheap about that one. in fact it's an incredible experience, open and educational to say the least.

    you and i do not participate in these things because "he said and she said', we do it for ourselves. please always remember that. set aside egos for a larger motive and see if it feels good....

    for days i bumped the state chapters thread up with minimal response. here was an opportunity to meet others like you and plan these meetings together. what's the good reason for that apathy?

    the window is not closed. this is a long journey. i urge you to join your chapters or to create one. you will find it a rewarding experience..

    i will be happy to provide details and answer questions on this from anyone interested.

    All I heard is something like below. I am not sure what I heard is correct.

    1. Bes tway to take 401K out is to rollover the 401K into Roth IRA and then withdraw from the account after 5 years. You can save lot on taxes.

    2. For all H1b holders, there is a form which you can fill and submit to IRS which says you want to get all the SSN money back. But once you fill out this form and get the money back, you SHOULD NEVER enter US for any reason. I do not know what the form is.

    Hi,

    i too got an email saying card production has been ordered....

    was overjoyed....

    few days later I recieved a cover which almost looked like it could be the card...

    I was about to open it that my wife woke me up saying...."it's time to go to the office, get up"

    I had an arguement with her after that saying...you should have waited 2 more minutes before waking me up....we would have had a gc if you had waited.. !!

    anways, back to square 1.

    Given thanksgiving is barely a week away, we can be certain of the usual platitudes directed at immigrants - this is a good time to remind the average American how far they have strayed from their roots and forgotten the true sentiment behind the tradition. Immigrants have always been hated and reviled by those that got here earlier - but the current anti-immigrant sentiment is vastly different in scale and sophistry due to the times we live in. If every IV member signs up 10 citizens to the immigrant cause, we should easily be 100,000 strong in a couple of weeks. It could be anyone from your advisor at school who mentored you to your buddies at work - even the stinkin relatives should be harassed. Though CIS and Numbersusa pretend that they are a product of the current anti-illegal sentiment, they started out much before the so-called 'wave' started. And they have adapted and honed their strategies very well to crush whatever relief Congress contemplates/passes. Consider the way CIS was initially dedicated to 'researching' immigrant issues that they would complain about the media's positive stories about immigrant contributions as merely anecdotal evidence not worthy of rebuttal. Now they are suddenly fond of anecdotal evidence themselves since experts began demolishing their claims of job-stealing and other baseless charges convincingly(esp CFR's Sebastian Mallaby) using empirical evidence-they shamelessly stoop to use someone's sob story to make their case. So, as repugnant as their motives are, they are too transparent for their own good- and they can't cover their tracks -which is good for us since we are appealing to the fair minded. Remember - every one in the US is an immigrant or an offspring of one. They have always been hated and reviled -so if someone who benefited from the immigrant tradition of this nation wants to turn around and deny it to those following him/her even though their ancestors did the same thing at a great emotional/economic cost to the then existing natives- they have a higher bar in explaining why the current bunch shouldn't continue to benefit from the great tradition-merely being bigoted but sophisticated enough to hide it isn't enough. so don't lose heart but dont sit on your ass either.

    Its a funny idea that we can help them write a pgm. But be real, It is a gov data and will have sensitive info. It takes money to make money. So lets spend it.. 5K is not a big deal. It is perfectly legal to ask for money when we need info from FOIA.

    its probably a better investment to get a Masters degree in your specific area than an MBA. Of course then you get pigeon holed in your specific area
    I agree: the MBA gives you perspective on strategic management and is useful in every field. But if it is not from the very very best schools, I would go for an MS in your own field. An MS from Univ of Arizona is almost as good as an MS from Berkeley when it comes to propelling your career. But an MBA from Berkekely is a different story. Of course, it is very hard to get into those top schools.

    Our current immigration system is broken, which is why I believe Congress should work to pass bipartisan, comprehensive immigration reform. Comprehensive immigration reform should include policies to secure our nation's borders, curb future illegal immigration, establish an effective employer verification system and find a practical solution for the millions of illegal immigrants currently residing in the U.S.

    I do not believe that illegal immigrants should gain an unfair advantage from their actions. Any effort to earn legal status must include paying back taxes, a fine or penalty and taking steps to learn English. Reform should also not penalize those individuals who have followed the law and are here legally.

    On April 23, 2010, Arizona Governor Jan Brewer signed into law Arizona State Bill 1070, which grants broad powers to local law enforcement officials to determine and request proof of legal status of anyone suspected of violating federal immigration laws. The enactment of this new law is yet another sign that the federal government needs to act to fix our broken immigration system rather than allowing for a state-by-state patchwork of laws and ordinances. I also believe Arizona's law raises civil rights concerns, fails to recognize the economic contributions of legal immigrant workers, and harms our nation's ability to attract entrepreneurs from around the world who create jobs here in the United States.

    Our nation faces many tough challenges. Immigration reform is a complicated and difficult issue but the current system is not working. We must put our differences aside to create a better system.
