Don't waste time by calling National Call service center. They all are dumb !! They don't know anything. They just read the on line status of our case, which 8 year kid can do.

USCIS accepts AP renewal applications 120 days in advance of expiring AP. The normal processing time for AP is approx 1-2 months (usually it is about a month). Keep in mind that the new AP which is issued will have an immediate effective date from the date of issue and the start date will not be from the expiry date of old AP. So in most cases you will end up losing some days or even months. If you do not forsee any immediate need to travel you should wait till 30-40 days prior to old AP expiry and then apply. If your travel plans are unknown and you may have to travel if an urgent situation arises, then you should apply 120-90 days in advance to make sure you have AP validity at all times. You will obviously lose some days or months... but then who says everything that USCIS does is fair :)

Hi Gurus,
Right now I am working for Company A and VISA with company A is valid till September 30 2007. Company B applied for Regular H1-B transfer (Receipt Date May 12) and it is still under process. I will be joining Company B on 1st October 2007.
Now due to some emergency I am traveling to India on 11August, 2007 and will come back on 11 Th September 2007. Also I can’t go for VISA stamping in India for Company B as I have not got my H1 Approval yet.
Given the above scenario, will I have any problem at the port of entry as my H1b transfer from company B has not been approved yet?

I don't think the tech companies are lobbying (strongly enough, if at all) for EB GCs. They are happy as long as H1 quota is increased which I think they will get in one form or the other.

Please find out the visa numbers allotment for EB1, EB2 and EB3 till now. Till now there is about 100k visa numbers allotment for EB3 every year due to the vertical fallout. From now on there would be around 100K allotment in EB2 due to the change to Horizontal Fall out of visa numbers. Out of these 100k EB2 visa numbers, India will get greatest share of around 50k + visas. Please see the below.

I am self filing I-131. I have couple of questions. Can anyone help me with these?
I am a July 2007 filer. I paid the old I485 fee (and biometric fee). I understand now I have to pay $305. But the instructions also say I need to pay $80 biometric fee. My fingerprints were done in 2007. I do not see anywhere in I-131 instructions that says 'Biometric fee is not required if fingerprints were done already or may be I overlooked it', but it seems someone posted in this thread, bio metric fee is not required.
My question is do I pay $80 now or not?
My second question is on "Class of Admission".
My last entry to US was on H1-B. Now I am working on EAD. What would I write in this box? H1-B or EAD or "Pending 485" or "Advance Parole". I was thinking it is H1-B, but wanted to make sure as I do not want to take any chances...?

I applied for my H1-B 3yr extension and am waiting for approval. Right now I dont have a valid 797, all i have is a h1B application receipt, do I just have to include this in the 485 application package instead of the 797? Is this going to be a problem?

There were some glitches in my plan last evening and I couldn't be around for as long as I anticipated.
After the last weekend drives in NorCal, my own tally rose to 150.
Actually anyone can spend an hour or two on this, and see how easy it is to score at least a hundred!

I guess they(morons, per your definition) are all techincally correct based on past memo's explaining USCIS stand on postmark dates,last working day in a month rule, the time at which the application was received(the revised bulletin was not yet published) etc etc
no matter what, the decision of accepting the applications is at USCIS's discretion.They can reject applications received in the last week of June as well if they want to.Period.
WHICH is why we need to contact the Lawmakers NOW about this and request more transparency.

Guys,
There's no doubt CIR is going to be brought in this year. How much of it or any of it will get passed, is the issue. Congress, as last year is determined to amalgamate us with the illegals so they can freely oppose the bill and indirectly kill both kind of immigration. I think we should put all our resources towards lobbying and make as many friends on the hill as possible.

that is true and if you actually go a hospital u know that the nurses are really needed. maybe we should get a direct GC too :)
H1B was misused and abused so much by the industry that the local
population has become hostile to the whole concept of foreign engineers/IT workers. Companies like Infosys, TCS hire 100% IT staff from India etc.
(saying that no US citizen/GC available...thats like lying in broad daylight)
Nurses came on Green cards and were free to change jobs etc. so
they affected the local job market to a far lesser degree so the opposition
is less.

I got approval email too. It cant be sheer luck that so many people are getting the approvals when it was taking 3 months as per their published processing times. Looks to me they just want to give 1 yr EAD to as many as possible. Good way to make money in recession year.
