I guess the cat is out of the bag. Yes, I got my greencard a few weeks ago. Yes, my PD is early 2004.
There are 2 current theories why:-
1. I'm very vocal in the media and lawmakers about the problem, and something made this happen (as my co-workers say "they gave it to you to shut you up")
2. I was a lucky one that was assigned a visa number in early June (when I applied for AOS) - it was approved when my PD was not current.
I'm not going anywhere, nothing has changed with the current policy. It is still broken. If for no other reason, the bizarre circumstances around my GC highlight more unpredictability and uncertainty in the whole process. I hadn't mentioned it before since it really isn't a big deal in the big picture.
Congrats.. and good to know that inspite of getting GC you have decided to stick with non-GC holders like us...
Thanks for your great efforts.

Oh Boy!, I feel like hugging you (Jadu ki zappi). By the way my story is very similar to you
Came to USA in 1999 to do MBA from a top US school. Joined a multinational org in 2001, filled my labor in 2002, got laid off in 2005, Filled my another labor in 2005.
But look , I am cool!:)
Frist, sorry for the confusion. I do have a 05/2007 PD at Atlanta PERM center. I came to the country in 1999 for grad school, started working with OPT in 2001, converted to H1 in 2002, laid off in 2002, started working again in 2002 with a new employer, filed labor in 2004 and got stuck in BEC ever since. The employer refused to file PERM, so I had change to a new company in 2006, and had PERM filed in 2007 and got stuck there again. Your are right, I am technically not in BEC, but psychologically I always feel I am in there.
I did not know what was 'disruptive' and 'inappropriate' about what I said. This is a board for BEC victims, so BEC victims are not allowed to express our frustration? I just expressed my depress and my concerns over how much this will retrogress the PD without targeting anyone. When tons of people run in front of our queue and shut us out in cold, we are supposed to 'enjoy the moment' with them? If so, when USCIS said no one can file 485 on July 2nd, why none of the people enjoy the happiness with those who already filed, because that will make their processing time much faster. People said we should feel happy for those who can file, because they now can get EAD/AP for their spouses, as if our spouse do not need EAD/AP. And as a result of this total mess, I don't think we'll have hope in another several years to see the date current.
IV core keeps telling us, BEC is always on their agenda. Really? If they did not even understand our pain and consider our frustration a disruption to people's happiness, how can we expect them to help? I still think IV is a great org, as it's the first such organization to speak out for legal immigrants. But when it comes to BEC victims, I did not see IV changed anything, or intend to change anything.
btw my original ID is still being banned

http://www.competeamerica.org/news/alliance_pr/20060630_shadegg.html
I'm sure the AILA guys can get Democrat votes for this measure. After all, they're supposed to be Pro-Immigrant, right??
IV- i think we ought to send webfaxes to the Reps who've introduced this bill for legal immigrants. This is a concrete step towards honoring America's tradition of welcoming Lawful Immigrants. Could you guys set it up? The least we can do is thank these guys. After all, its not easy doing this with "Crank Tanc" around...

can we stop "the ombudsman" from posting messages that have absolutely no logic just pasted articles from right wing media/blogs?
who is he to keep us flowing in the right direction?
I am glad someone on this site injects a daily dose of reality - half the people that post are out to lunch, anyway!
Keep it up, Ombudsman! And let the whiners whine! There seem to be too many of them, anyway. Lots of people who come up with lots of "suggestions." Mostly nonsense, anyway. And then there are some that post messages in the news article thread that are simply wrong and inaccurate. Some people are still in third grade...they believe everything that they read. And believe everything that they hear on TV or the radio. If Chris Matthews or Bill O'Reilly is your source of accurate news or objective analysis, why, even the heavens weep for you!
BTW, there are people on here who think that "The Nation" is a right-wing newspaper! How retarded is that! Katrina van den Heuvel, the editor of The Nation, is no right winger!
check out www.mediamatters.org for another healthy dose of reality checks.

Last update from IV Core about administrative fixes talked about EAD duration being extended to 2 years, but never saw anything about 2 year AP decision (It would have been good though).
I must have missed it, but wondering if there was any USCIS announcement/FAQ out there for the 2 year duration decision?

At my workplace, about 50% of them have have signed this letter now! This is including but not limited to employees with an immigrant background ( including but not limied to the Indians and the Chinese!)
My tally is now up to 253. Expecting another 2 this evening from a friend who got it from 2 of his own friends.
Recruit friends & strangers to help you, then follow up a little bit, it helps!
Exciting stuff. I am at 237 and there is a chance I will get some this weekend so I will take care of those last ones. Come on folks, please do the best you can.

I think Both Sen.Obama and Sen.McCain are interested in legal Immigration. Mitt Romney was a big Advocate of legal Immigration. But of course, these are not the priority Items for both the candidates and also have to reassure the citizens that they will create new Jobs. Both of their plans will not affect Outsourcing
Sen. Obama Proposes to end the tax breaks for companies who outsource their work to other countries. This will not have any Significant effect on Outsourcing, as companies save much more by outsourcing , than tax breaks.
Sen. McCain already said that the lost jobs are lost, he will invest in re-training the workforce and find new areas of employment which cannot be outsourced.
I dont expect this Question to be heard in the forthcoming debates , as this Question was asked since the interview was conducted in Columbia Univ( University who supports EB Immigration)
Seriously...both r of no use as far as legal immigration is concerned

Again what is the point in moving to Canada just because you are tired in waiting here. Are you going to do the same job in Canada. If yes, I would do that here.
For me, only person who could move to Canada is:
1. Way better career jump.
2. Do not have wavery mind of coming back to US. If happens come back, but do not start with that as you will not lead happy life.
3. Keep the GC processing alive in US.
I think Canada might be a good option for some ppl. Here are some reasons:
You move to canada, have greater flexibility to change jobs, your wife gets to work, in the meanwhile your employer lets the GC process continue. This way, you live a free life until you get a GC. But I seriously doubt if any employer will continue to process GC if you leave the country.
Or you have waited long enough and are too tired to wait any longer. You would rather be elsewhere. In this case it doesn't matter where you go, Canada or back home.
Another good reason can be that you have waited for 8-10 years in US and have no hope in sight. You are not tired but you can clearly see that the wait is completely futile and you are just hoping. You have decided to stop waiting but still want something that's close to US standards. And I think canada still comes very close to good standards.
What do you guys think?

of course they will accept them
and they will accept your 485 and AP and EAD...
as long as they can cash the checks.
the law has not changed, no one can presume what will happen
it's just that we are the fools in this, spending thousands of dollars without any choice in the matter, and then in one sweep all of it will be laid waste and we will be starting again...
what's more, for the indians among us, with the merit system, when with 90 points on board you will have no assurance of ever getting a green card.
what a alife :-) :-( yeah both, i can't decide!!

Bharat,
Did you read post#43 ont his thread. Doors are closed for canadian PR for those are in NON Managerial IT positions. Try Australian PR. here is the helpful link
MODL - Migration occupations in Demand for Australia (MODL) (http://www.australia-migration.com/page/MODL/58)
There is a lot more Racism in Australia than Canada nowadays as you must have read in the news. Also anyone moving from US to Canada it will be easier to move, as the culture is pretty much the same. Road rules are the pretty similar. But getting a job would be tough compared to australia.
But I would still say Canada is still a better option than Australia (lot of natural resources)

Mate if you are an Indian there is no place in India where you can avoid Hindi. Hindi is our national language and that does not make it optional for you to speak or understand.
Have you ever visited south India?

if you are a desi no reason for you to not know hindi mate....hamara bharat mahan
Well, I've got a few reasons.
1. I don't like the attitude that comes along with the people that speak it.
2. I just don't like the language.
3. I don't live anywhere close to a place where I must know Hindi to survive.
4. The Indian Constitution recognises English as a subsidiary official language.
5. If I have survived as long as I have without knowing Hindi, I'm sure I can survive without knowing Hindi for the rest of my life.
