Hi,
I have my H1B from company A.Now I am planning to have H1 transfer to company B. I don't have a record of the experience letters(2000 - 2003) I submitted when I filed my H1b through company A.
Now when I am applying for H1 transfer from company B can I just submit the experince letters from 2004-2007 including the letter from company A so that they don't contradict with what I have submitted before??.
I would also be submitting my education evaluation,w2s,recent paystubs etc. The problem is only with my previous experience letters.
please let me know if this is okay or can there be a problem.Any help would be greatly appreciated. This is urgent for me!!!

u and ur non-retrogressed friend have my support for an expedited process since u got US advanced degree that make u better suited for this market.. u should be talking STEM.. i am talking about the disparity in available opportunities to come here back in our homelands. Individual examples aside, I trust statistics, you'll find that each year a handful of giant offshoring companies grab more than half the H1 quota.. is it my streotyping imagination that infosys, wipro and satyam don't hold job fairs in Romania and they only make these opportunities available in retrogressed countries?
Hello! Infosys, Wipro and all those companies are NOT the main sponsors of green cards, which is the reason we're in this forum, no? Most of the sponsors are US based small and medium sized companies.
I don't care how many visas they get, the fact is that it doesn't affect me! I neither have a job with them nor I benefited from them grabbing a bulk of visas. End of the day I'm held back because of where I was born.
Look, this may be hard for you to understand, but just because those companies are in my country didn't and doesn't help me one iota. Everyone's on their own here.

I am happy that we see a change. The Iraq war is not going well. I do not believe that Democrats are necessarily more qualified and honest than Republicans, but the balance of power is welcome.
Regarding to immigration, my point is that I am certainly happy that we may see things moving - not because they will move directly suited to our category - but we may take a ride with the amnesty CIR bill. That is indirectly positive to us and that may turn out to be good thing indeed.
Since the Democrat led bill is primary designed to satisfy employers looking for low income labor and supply democrats with potential voters in the future, my concern is that many of us may get into trouble ahead, when millions of illegal aliens get their cases in the USCIS queue. In addition, I have to observe that I have a long-term vision:I believe that an amnesty of this magnitute will bring the US to its knees in the mid-term. That is more a long-term vision, but that's what I think and if that is correct, that is certainly troublesome because that would make all my efforts to get a GC unviable at that point. I would not worry about that now. We need to finish our GC business and get out of this as soon as possible.
Some members of this forum continue to distort facts. Nothing has changed for me. I captured all the information I had available back then and discussed with you all. In the last two months violence in Iraq has escalated to unacceptable levels and that has changed the outcome of the elections, apparently to our short-term advantage. It is time for a change for sure. Let's welcome the change.
Again, I am planning to discuss our issues and constantly and deliver fresh daily comments to you all on daily basis. Let's hope that we will have more positive news coming.

What about people with pending PERM applications?
The problem is quota of 90,000 visas is available for petitions filed before October 1st 2007. MBS will not start until October 1st 2008 (because of 270 days gap). There is no guarantee that BECs will process petitions by Octobet 1st either. Someone has to clarify if pending labor petitions will be eligible for the 90,000 quota or not. The INA section 212(5)(A) refers to labor petitions in general - PERM or BEC.

How can you say there is no stress for the person working at home, raising the family?
The poor H1 soul is constantly over-stressed as he is supporting a spouse and a child or even two children.
Imagine how the H4 spouse feels...he/she cannot do a thing to alleviate frustrations of his loved ones as her hands are tied..
I deeply care for my husband and I had lived through some agonizing days in the past when he was out of work, without salary etc..knowing how much he is in pain himself as everyone and everything depends on him, literaly....
We will be moving away soon 'cause we care too much for each other's happines to continue to live in the circumstances where we only suffer ...

Just based on the definition given by DOL I decided Level III and Level IV to be EB2. Besides I am EB2 and my wage level is Level IV. I agree it is hard to conclude the cat based on wage level, I saw there were some Senior welders in Level III as well as Vice presidents of the companies. Quite a contradiction isn't it!!
I think Level indicates the Step within the existing Job Title. For example, a Senior Programmer Analyst could have a level 2 or 3 but an Entry level Project Manager could have a level 1 or 2. I think one would have to use a combination of Level and SOC Code.

I don't think it bodes well for anything that is sent to the Table. This Senate Language Glossary has what "motion to table" means, essentially something that senate does not want to Consider. This Amendment(1249) is said to have been ordered "to lie on the table" not sure if it is same as the motion to table. But, I think we should hope for an amendment that does not have a table associated with its status.

I am working with a consulting comp since 6 months. Now, I got a permenant offer from other comp and they have applied for transfer ( i have fedex receipt).
Now, I have a employment agreement with my company A which says I need to work with them for 12 months or need to pay 9500$. I can give 2 weeks of notice along with this. Contract is not on there letterhead but It has stamp with there address ( no company name on stamp). Contract says there name. Also signed is done by a marketing person of that comp.
Is that valid contract? Can they ask me to pay 9500$ or sue me on that basis?
Please reply me urgently as I need to decide what to do.

This sort of response is not surprising at all to me. I sent individual emails to at least twenty members from my state to try and galvanize some action and did not receive one single reply.
There are four of us who seem to be keen to try to get something moving but that seems to be a bit lame when we can only muster four people from an entire state.
